Attorney General Dr Dominic Ayine has posited that the call by his predecessor, Godfred Yeboah Dame, that President Mahama suspend consultations which seek to remove the Chief Justice from office is in variance with the law. The lawmaker argued that the law is clear that one cannot enjoin the discharge of a constitutional duty. Speaking to journalists on Wednesday, April 16, 2025, Dr Ayine said the consultation process initiated by the president constitutes the performance of a constitutional duty which cannot be stopped. “He has applied to the court, and the court is yet to make an order. So, is he saying that the court must hold on? Is he saying that the court has already granted an order in respect of which the president must not continue the process?” Dr Ayine questioned. “He must understand that it is the constitutional duty, and the law is very clear that you cannot enjoin the performance or conduct of a public communication,” he added. He made the remarks after another adjournment by the Supreme Court in a case seeking to prevent the president and the Council of State from moving forward with the process. The adjournment was due to the absence of one of the five justices presiding over the case, His Lordship Samuel Asiedu.
