It's the weekend and therefore time for a look at the cases that have recently come before Cornwall's magistrates. Everyone who has been charged with an offence, from the least to the most serious, appears initially before the magistrates. The most serious cases are then sent to the crown court. If a defendant pleads guilty, they could be sentenced straight away or have the matter put back for a pre-sentence report. If they deny the allegations against them, the case will be adjourned for a trial. The courts are open to anyone and our reporters attend just like any other member of the public. As most people have jobs and cannot spend their time in court, the media has always acted as the eyes and ears of the public to ensure that justice is seen to be done. On that same day without lawful excuse, damaged a Vauxhall Astra Index to the value of unknown belonging to [victim] intending to destroy or damage such property or being reckless as to whether such property would be destroyed or damaged Suspended sentence. Must complete six month alcohol treatment and rehabilitation activity. Must pay £85 costs and a restraining order was put in place. Eugene Clemence Aged: 35 Little Gregwartha Four Lanes, Redruth On February 8 in Redruth had in his possession a quantity of cocaine, a controlled drug of class A, in contravention of section 5(1) of the Misuse of Drugs Act 1971. That same day at Camborne police station when suspected of having driven a vehicle and having been required to provide a specimen or specimens of breath for analysis by means of a device of a type approved by the Secretary of State pursuant to section 7 of the Road Traffic Act 1988 in the course of an investigation into whether he had committed an offence under section 3A, 4, 5 or 5A thereof, failed without reasonable excuse to do so. Forfeiture and destruction of the cocaine. Driving disqualification for 17 months with a reduction period of 17 weeks. £200 fine and £85 costs with £80 surcharge. Joshua Marsh Aged: 26 Green Lane Fowey On November 11, 2024, at St Austell, drove a motor vehicle, namely a white KTM motorcycle, on a road, namely A391 Carclaze, St Austell, when the proportion of a controlled drug, namely Delta-9-tetrahydrocannabinol (THC), in his blood, namely not less than 6.2 micrograms per litre of blood, exceeded the specified limit. Drove a motor vehicle, namely a white KTM motorcycle, on a road, namely A391 Carclaze, St Austell, Cornwall, otherwise than in accordance with a licence authorising him to drive a motor vehicle of that class. To pay £85 costs with a £45 surcharge in installments. Disqualified from driving for 36 months. Fined £120. Craig Bryant Aged: 33 Old Mill Lane Roseworthy On November 9, 2024, at Roseworthy, without reasonable excuse, he visited locations and interacted with [victim], and then proceded to leave a card on her vehicle with his phone number contained within, which he were prohibited from doing by a restraining order. On October 12, 2024, at North Roskear, without reasonable excuse, he arrived at [victim's] address and shouted up into the window, expressing his love for her, which he was prohibited from doing by a restraining order. Ordered to pay costs of £85 with a surcharge of £187.40 weeks imprisonment, suspended for 12 months. He was told he had a "fragrant disregard" for court orders. Wayne Nunn Aged: 38 Chypraze Court Treswithian On December 8, 2024, at Newquay, drove a motor vehicle, namely Vauxhall Astra, on a road, namely Rialton Road, when the proportion of a controlled drug, namely Benzoylecgonine, in his blood, namely not less than 522 micrograms of drug per litre of blood, exceeded the specified limit. Must pay £85 in costs. Disqualified from driving for 12 months. Fined £506. George Bowden Aged: 27 Saracen Way Penryn On September 24, 2024 at Falmouth Tyres, Berkely Vale, assaulted [victim] by beating him. Community order made. Must complete rehabilitation activity and pay £200 compensation. Nicole Shaw Aged: 31 Bread Street Penzance Failed without reasonable excuse to comply with the requirements of a community order made by Northamptonshire Magistrates' Court on 14/10/2024. Between 15th October 2024 and 16th of April 2025 failed to keep in contact with the probation service in accordance with Part 2 of Schedule 10 to the Sentencing Act 2020. The original offence relates to a series of thefts, including the theft of seven pizzas to the value of £32.20 from a Co-Op store. Community order made. Must complete a drug rehabilitation requirement. Fined £120. Kieran Leverett Aged: 41 Blowing House Close St Austell Failed without reasonable excuse to comply with the requirements of a community order made by Cornwall (Bodmin) Magistrates Court on 17/01/2025, he failed to attend, as directed, a supervision appointment on 26.02.2025. He failed to attend, as directed, a supervision appointment on 13/03/2025. He failed to provide an acceptable reason and/or evidence to substantiate a reasonable excuse for the failures within five working days. Fined £80. Ison Alli Aged: 23 Polmeere Road Penzance On February 8 at Polmeere Road, Penzance, he had with him without good reason or lawful authority, in a public place, a kitchen steak knife which had a blade the cutting edge of which exceeded 7.62 centimetres (3 inches). Community order made. Ordered to pay £85 in costs and a surcharge of £114. Fined £120. Must also complete a mental health treatmnt requirement.
